Beauty sells through photos, tutorials and your own store, so claim one name on the .com and the visual platforms. Then check the words you plan to put on the label.

Which trademark classes cover a beauty brand?
Class 3 covers cosmetics and class 44 covers salon services. Medicated products, such as medicated lotions and shampoos, go in class 5 instead.
| Class | WIPO covers | For a beauty brand |
|---|---|---|
| 3 | Non-medicated cosmetics and toiletries, perfumes | Skincare, makeup, fragrance |
| 44 | Hygienic and beauty care | A salon or spa |
| 35 | Retail services, among other things | A shop selling other brands |
| 5 | Medicated shampoos, soaps, lotions (WIPO's class 3 note) | Medicated skincare |
Each extra class adds $350 in the US, €50 to €150 in the EU and £60 in the UK. Read Do I need a trademark before I launch? before you file, and Trademark classes for beauty brands for the full list.[2, 4, 5, 6]
Which claims could make your product a drug?
In the US, a product's intended use decides whether it's a cosmetic or a drug. Claims on the label, in ads or online can make it a drug, even if you sell it as a cosmetic.
| Claim | Why it matters |
|---|---|
| Restores hair growth | FDA lists it as a drug claim |
| Reduces cellulite | FDA lists it as a drug claim |
| Treats varicose veins | FDA lists it as a drug claim |
| Changes skin pigment | FDA lists it as a drug claim |
| Regenerates cells | FDA lists it as a drug claim |
Keep promises like these out of product names and taglines; Words to avoid in a beauty name has more. Other countries set their own rules.[3]
