What makes a good restaurant name?

A good restaurant name is distinctive, easy to say and spell, and more than a plain description of your food. The USPTO says a name like "Bagel shop" for a bagel shop is generic and can't be a trademark at all.

RuleWhy it matters
Distinctive, not descriptiveThe USPTO rates invented and unrelated words as strong, and descriptive names as weak
Not close to another markSimilar marks for related services can be refused, even when they aren't identical
Easy to remember, say and spellThe USPTO suggests weighing all three before you choose
Letters and numbers onlyA .com takes no periods or underscores; TikTok takes no hyphens
5 to 24 characters, as one wordFacebook usernames need at least 5; TikTok allows up to 24, with no spaces
Not registered in your stateMost states refuse a name someone else already registered

How do you check if a restaurant name is available?

Type it into our checker: one search covers the .com, Instagram, TikTok and Facebook. Our checks read each platform from the outside, so confirm a name when you sign up (how our checks work).

Check your name

We don't check state business registries, so search your state's register too. For domain endings and trademark classes that suit food, see Brand names for food & drink.

Can two restaurants have the same name?

Sometimes: without a federal trademark, your rights come from using the name and may reach only the areas where you use it, the USPTO says.

A federal registration covers the whole US. Names don't have to be identical to clash, though: similar names for related services can be refused. Identical marks can share the register when the goods and services aren't related.[2, 7]

Do you need to trademark a restaurant name?

No. The USPTO says filing is your choice, but registration extends your rights to the whole country and lists your name in its public database.

A restaurant's trademark class is 43, which covers restaurant, café and takeout services. A US filing costs $350 per class. Check US trademarks first, and read how to trademark a name before you launch.[7, 8, 9]
