Which trademark classes cover an eco brand?
Start with the class for what you sell, as any brand would. Class 40 covers recycling, upcycling and the production of renewable green energy.
| Class | WIPO covers | For an eco brand |
|---|---|---|
| 40 | Treatment of materials, recycling of waste and trash | Recycling, upcycling, renewable green energy |
| 39 | Transport, packaging and storage of goods | Waste collection, energy distribution |
| 4 | Fuels and illuminants, candles | Electrical energy, biomass fuel, soy candles |
| 11 | Apparatus for lighting, heating, cooling and water supply | Heat pumps, solar thermal collectors, water filters |
Each extra class adds $350 in the US, €50 to €150 in the EU and £60 in the UK. Read Do I need a trademark before I launch? before you file.[2, 5, 6, 7]
Can you call your brand "eco-friendly"?
Not on its own. The FTC calls a brand name like "Eco-friendly" deceptive, and the EU bans generic green claims made without proof.
| Where | Claim | Rule |
|---|---|---|
| US | "Eco-friendly" as a brand name | Deceptive on its own |
| US | "Eco-friendly: made with recycled materials" | Can pass if clear, prominent and provable |
| EU | "Eco-friendly", "green", "climate friendly" | Banned without proof of excellent environmental performance |
| EU | Neutral or reduced emissions, based on offsets | Banned |
EU countries apply these bans through their own laws from 27 September 2026. Other countries set their own rules.[3, 4]
